EABL says Bia Tosha’s court case unaffected by Asahi acquisition

East African Breweries Limited (EABL) has issued a statement in response to a court matter filed by former distributor Bia Tosha, clarifying that the dispute is unrelated to the recently announced Diageo-Asahi transaction.

EABL said the case pertains to a long-standing disagreement over distribution territories in Kenya and emphasized that it bears no factual or legal connection to the corporate transaction.

“This application is merely the latest iteration of an unsuccessful 10-year campaign by a former employee and former distributor—now a serial litigant—to destabilize and damage EABL’s business operations. All claims made are devoid of truth,” the statement read.

EABL added that, despite the change in majority shareholding, both EABL and Kenya Breweries Limited (KBL) remain independent and fully capable of conducting business and defending any litigation. The company warned that any suggestion to the contrary is false and detrimental to Kenya’s reputation as a destination for high-quality foreign investment.
